General Terms and Conditions

Last updated: October 2026

This version is a translation of the German original. The German version is authoritative.

1) Scope

1.1 These General Terms and Conditions (hereinafter “GTC”) of 24fire GmbH (hereinafter “provider”) apply to all contracts that a consumer or entrepreneur (hereinafter “customer”) concludes with the provider in respect of the services presented by the provider on its website, in its control panel (cp.24fire.de) and on its donation pages. The inclusion of the customer's own terms is hereby objected to, unless otherwise agreed.

1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

1.3 An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession.

1.4 The provider's Acceptable Use Policy applies in addition. It governs which use of the services is permitted and which is prohibited.

2) Services of the provider

2.1 The provider makes available to the customer in particular virtual servers (KVM servers and storage servers), dedicated servers, webspace and domains as well as related additional services (such as additional data volume, IP addresses or backup slots). In addition, it offers the "24fire+" membership (section 17), donation pages (section 18) and occasionally goods (section 19). The exact scope of each service follows from the provider's service description at the time of the order.

2.2 The provider's services in transmitting data are limited solely to the data communication between the transfer point of its own data communication network to the internet operated by the provider and the server made available to the customer. The provider has no ability to influence data traffic outside its own communication network. Successful forwarding of information from or to the computer requesting the content is therefore not owed in this respect.

2.3 The provider's online service is offered subject to availability. 100 per cent availability cannot be achieved technically and therefore cannot be guaranteed to the customer by the provider. However, the provider endeavours to keep the service available as consistently as possible. In particular, maintenance, security or capacity requirements as well as events beyond the provider's control (disruptions of public communication networks, power failures, etc.) may lead to disruptions or to the temporary shutdown of the service.

2.4 Where backup slots form part of a service, the customer can use them to create backups of their server; which and how many are included in the price follows from the service description. Beyond this, the provider does not create backup copies of customer content. The customer is responsible for creating and maintaining sufficient backup copies of the content stored with the provider and for not storing it exclusively on the provider's servers.

2.5 The provider is entitled to adapt the hardware and software used to render the services to the respective state of the art. If such an adaptation gives rise to additional requirements for the content stored by the customer on the server in order to ensure that the provider's services can be rendered, the provider will notify the customer of these additional requirements in good time. In this case the customer must notify the provider, no later than four weeks before the changeover date, whether they will adapt their content in good time — that is, no later than three working days before the changeover date — to the additional requirements. If the customer refuses to adapt their content or does not declare their position to the provider within the aforementioned period, the provider may terminate the contractual relationship with effect from the changeover date.

3) Changes to services

3.1 The provider reserves the right to change the services offered or to offer different services, unless this is unreasonable for the customer.

3.2 The provider further reserves the right to change the services offered or to offer different services,

  • insofar as it is obliged to do so due to a change in the legal situation;
  • insofar as it thereby complies with a court judgment or an official decision directed against it;
  • insofar as the respective change is necessary in order to close existing security vulnerabilities;
  • where the change is merely advantageous for the customer; or
  • where the change is purely technical or procedural in nature without material effects for the customer.

3.3 Changes with only an insignificant influence on the provider's services do not constitute changes to services within the meaning of this section. This applies in particular to changes of a purely graphical nature and the mere rearrangement of functions.

4) Conclusion of contract

4.1 The services described on the provider's website do not constitute binding offers on the part of the provider, but serve to enable the customer to submit a binding offer.

4.2 The customer may submit the offer via the online order form provided on the provider's website. In doing so, after entering their personal data, the customer submits a legally binding contractual offer in respect of the selected services by clicking the button that completes the order process ("Order with obligation to pay"). Placing an order requires signing in with a customer account (section 11).

4.3 The provider may accept the customer's offer within five days,

  • by sending the customer a written order confirmation or an order confirmation in text form (fax or e-mail), whereby receipt of the order confirmation by the customer is decisive, or
  • by requesting payment from the customer after they have placed their order.

Where several of the aforementioned alternatives apply, the contract is concluded at the point in time at which one of the aforementioned alternatives first occurs. The period for accepting the offer begins on the day after the customer sends the offer and ends at the end of the fifth day following the sending of the offer. If the provider does not accept the customer's offer within the aforementioned period, this is deemed a rejection of the offer, with the consequence that the customer is no longer bound by their declaration of intent.

4.4 If a payment method offered by PayPal is selected, payment is processed via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: "PayPal"), subject to the PayPal Terms of Use, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full or — if the customer does not have a PayPal account — subject to the terms for payments without a PayPal account, available at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full. If the customer pays by means of a payment method offered by PayPal and selectable in the online order process, the seller hereby declares acceptance of the customer's offer at the point in time at which the customer clicks the button that completes the order process.

4.5 The customer orders services paid for from their credit in the control panel — such as a package change, additional data volume, the restoration of a suspended server or the 24fire+ membership — by clicking the respective button marked as subject to charge. The contract is concluded with this click; the price is deducted from the credit immediately.

4.6 When submitting an offer via the provider's online order form, the contract text is stored by the provider after the contract is concluded and sent to the customer in text form (e.g. e-mail, fax or letter) after they have sent their order. The provider does not make the contract text accessible beyond this. The order data, invoices and the messages sent to the customer can also be retrieved in their customer account in the control panel.

4.7 Before bindingly submitting the order via the provider's online order form, the customer can identify possible input errors by carefully reading the information displayed on the screen. An effective technical means of better identifying input errors may be the browser's magnification function, which enlarges the display on the screen. The customer can correct their entries during the electronic ordering process using the usual keyboard and mouse functions until they click the button that completes the order process.

4.8 German and English are available for concluding the contract.

4.9 Order processing and contact generally take place by e-mail and automated order processing. The customer must ensure that the e-mail address provided by them for order processing is correct, so that e-mails sent by the provider can be received at this address. In particular, when using SPAM filters, the customer must ensure that all e-mails sent by the provider or by third parties commissioned by the provider with order processing can be delivered.

4.10 The contracting party is 24fire GmbH, Kronenstraße 4, D-68723 Schwetzingen. After receipt of payment, the services ordered are generally made available automatically in the control panel at cp.24fire.de.

4.11 The provider may limit the number of servers a customer can order within a certain period in order to prevent abuse of its infrastructure. If a limit is reached, the provider points this out before the order is submitted.

5) Right of withdrawal

5.1 Consumers have a right of withdrawal in accordance with the provider's withdrawal policy.

5.2 In the case of contracts for services, the right of withdrawal expires pursuant to § 356(4) of the German Civil Code (BGB) once the provider has performed the service in full, provided that before performance began the customer

a) expressly requested that the provider begin performing before the withdrawal period expires, and
b) acknowledged that the right of withdrawal is lost once the contract has been performed in full.

The provider obtains both declarations separately during the order process.

5.3 Once the selected hosting service has been provided in the control panel (cp.24fire.de), the service has been performed in full.

5.4 For the purchase of goods (section 19), the withdrawal policy for goods that the provider makes available with the respective offer applies.

6) Obligations of the customer

6.1 The content stored by the customer on the storage space designated for them may be protected by copyright and data protection law. The customer grants the provider the right to make the content stored by them on the server accessible when requested via the internet, in particular to reproduce and transmit it for this purpose and to be able to reproduce it for the purpose of data backup. The customer checks on their own responsibility whether their use of personal data meets data protection requirements. If the customer processes personal data on behalf of others on the provider's services, they can conclude a data processing agreement (Art. 28 GDPR) with the provider in the control panel.

6.2 The customer undertakes not to store any content on the storage space made available that violates applicable law or infringes the rights of third parties. The customer further ensures that programs, scripts or similar installed by them do not endanger the operation of the server or of the provider's communication network, or the security and integrity of other data stored on the provider's servers.

6.3 The customer indemnifies the provider against all claims that third parties assert against the provider on account of the infringement of their rights due to content stored by the customer on the server. In this respect the customer bears the costs of the necessary legal defence, including all court and lawyer's fees in a reasonable amount. This does not apply where the customer is not responsible for the infringement. In the event of a claim by third parties, the customer is obliged to provide the provider without undue delay, truthfully and completely with all information required to examine the claims and to mount a defence.

6.4 In the event of an imminent or actual breach of the above obligations, as well as in the event of the assertion of not obviously unfounded third-party claims against the provider on account of the content stored on the server, the provider is entitled — also taking into account the legitimate interests of the customer — to temporarily suspend the connection of this content to the internet in whole or in part with immediate effect. The provider will inform the customer of this measure without undue delay.

6.5 If programs, scripts or similar installed by the customer endanger or impair the operation of the server or of the provider's communication network, or the security and integrity of other data stored on the provider's servers, the provider may deactivate or uninstall these programs, scripts, etc. If removing the danger or impairment so requires, the provider is also entitled to interrupt the connection of the content stored on the server to the internet. The provider will inform the customer of this measure without undue delay.

6.6 The customer must keep their access credentials secret and protect them against access by unauthorised persons. The same applies to API keys, to authorisations the customer grants applications or services (such as the provider's Discord bot) for their customer account, to share links for individual servers and to access the customer grants to third parties. The customer must accept responsibility for actions carried out with these means of access insofar as they are responsible for the misuse. If there is a suspicion that unauthorised persons have gained knowledge of them, the customer must change or revoke the affected means of access without undue delay.

7) Security requirements

7.1 Every customer undertakes not to endanger the security of the site, in particular by:

  • not obtaining access to data that has not been released to them
  • not checking, scanning or testing the systems used to operate the site for weaknesses and security vulnerabilities, and not attempting to circumvent security or authentication measures
  • not forging header information or IP addresses in e-mails.

7.2 Furthermore, every customer undertakes to access and use the provider's services only via browsers that are customary according to the respective state of the art. Any measures that impair the proper functioning of the provider's services are strictly prohibited. This applies in particular to the following measures and attacks: XSS, SQL injection, CSRF, phishing, DoS, DDoS, brute force, session capture, automated or script-controlled access and other manual and automated attacks on technical infrastructure or interference with the provider's services. The intended use of the programming interface provided by the provider is excepted.

7.3 Violations of these security requirements may have consequences under civil and/or criminal law. The provider will investigate security violations and, where appropriate, prosecute them with the assistance of law enforcement authorities and enforce civil claims.

7.4 In the event of an abuse report concerning a server or an IP address, the provider is entitled to block the customer's server or IP address. The provider will inform the customer of the blocking by e-mail.

7.5 On new servers, sending and retrieving e-mails (the ports customary for this) is blocked by default. The customer can apply for approval in the control panel; there is no entitlement to approval. Upon approval, the customer is responsible for all messages sent via the server and may only send e-mails to recipients who have consented to receiving them. In the event of abuse, in particular the sending of unsolicited advertising, the provider may withdraw the approval and block the server at any time. Approval is excluded for free test servers.

8) Remuneration, payment terms and credit

8.1 Unless otherwise stated in the provider's service description, the prices given are total prices which include statutory value added tax.

8.2 The payment options and payment terms are communicated to the customer on the provider's website.

8.3 The provider processes online payments exclusively via the payment service providers PayPal (section 4.4) and Mollie B.V., Keizersgracht 313, 1016 EE Amsterdam, Netherlands (hereinafter "Mollie"). The payment methods available in each case are shown in the order, top-up or donation process. For payment methods via Mollie, the customer is directed to a Mollie payment page on which they confirm or authorise the payment; to carry out the respective payment method, Mollie involves the payment systems and credit institutions concerned. Further information is available to the customer at https://www.mollie.com/en. The provider does not offer payment methods in which it performs in advance vis-à-vis the customer (such as purchase on account or instalment payment); all services are payable in advance. Accordingly, no credit check takes place.

8.4 If advance payment by bank transfer (SEPA transfer) has been agreed, payment is due immediately after conclusion of the contract, unless the parties have agreed a later due date. The services are only made available once the invoice amount has been received in the provider's bank account.

8.5 Credit. The customer can top up credit in their customer account. The credit is earmarked credit (a single-purpose voucher): it can be used exclusively for services of the provider, in particular for renewing existing and purchasing new services. The credit cannot be paid out. The credit does not expire. Statutory claims to repayment, in particular after an effective withdrawal or where the provider does not render a service that has been paid for, remain unaffected.

8.6 The customer can set up a recurring top-up of their credit via PayPal in the control panel. In doing so, they conclude a payment agreement with PayPal through which the chosen amount is topped up at the chosen interval. The customer can end the recurring top-up at any time in the control panel or at PayPal. Apart from this, the provider never charges the customer's means of payment automatically.

8.7 Commissions and cashback from the provider's partner programme are credited exclusively as credit; section 8.5 applies accordingly. The conditions of the partner programme (amount, waiting period until crediting) are stated in the control panel and may be changed by the provider for future referrals.

8.8 Price changes. The provider may change the prices of existing services for future terms. A price increase takes effect no earlier than with the first renewal (section 9.2) that occurs at least six weeks after the notification; a term already paid for is not affected. The provider notifies the customer of the change by email to the address stored in the customer account, stating the service concerned, the previous and the new price and the date from which the new price applies. If the customer does not agree with the new price, they may cancel the service free of charge with effect from the end of the current term (section 9.4); the provider points out this right in the notification. If the customer does not cancel, the service renews at the new price. The provider may reduce prices at any time without notice. Services for which a fixed price has been promised are excluded, namely offers from the KVM Marketplace (section 14.6) and the 24fire+ membership (section 17.2).

9) Term, renewal and termination

9.1 The provider's services are paid for in advance for the term selected when ordering (prepaid).

9.2 Automatic renewal from credit. At the end of the term, a service is renewed for the same term unless it has been terminated under section 9.4 or 9.5 and provided that the customer's credit covers the renewal price at that time; the price is then deducted from the credit. Nothing beyond this is charged: the provider does not collect any amounts from cards, accounts or other means of payment and does not send payment reminders (for the recurring top-up set up by the customer themselves, see section 8.6). The provider informs the customer by e-mail before each renewal, separately if the credit is expected to be insufficient.

9.3 End due to insufficient credit. If the credit does not cover the renewal price, the contract ends when the paid term expires.

  • Servers and webspace are then suspended. The customer can restore them in the control panel within 5 days (for 24fire+ members within 10 days) against payment of the renewal price. After that, they are irrevocably deleted together with all data stored on them.
  • Domains are renewed 2 days before their expiry at the registry. If the credit does not cover the renewal price at that time, the domain is deleted; restoration via the provider is then no longer possible.

The option to restore a suspended service is a voluntary offer by the provider; there is no entitlement to it, nor to the periods stated. The provider may restrict restoration, shorten the periods or discontinue the offer at any time and without notice.

9.4 Termination at the end of the term. The customer can terminate any service at any time with effect from the end of the paid term, in particular in the control panel. The termination switches off automatic renewal; when the term expires, the service is deleted together with all data. Until then, the customer can withdraw the termination in the control panel. Amounts already paid are not refunded pro rata.

9.5 Non-renewal by the provider. The provider may terminate any service without giving reasons with effect from the end of the paid term, thereby declining its renewal. The termination takes effect no earlier than at the end of the term that ends at least six weeks after the notification; a term already paid for is not affected. The provider notifies the customer of the termination by email to the address stored in the customer account, stating the service concerned and the date on which it ends. When the term expires, the service is deleted together with all data; the customer backs up their data in good time beforehand. For domains, the provider makes the auth code for a transfer to another provider available on request until the end of the term.

9.6 Immediate termination. Where the control panel offers this, the customer can also terminate a service with immediate effect. The service then ends immediately and is irrevocably deleted together with all data. There is no entitlement to a refund or credit for the remaining term. If the provider grants a credit in an individual case or generally, it does so voluntarily and this does not establish any entitlement for future terminations; the provider may change or discontinue such a credit at any time.

9.7 Deletion of the customer account. If the customer requests the deletion of their customer account, all services running via the account end upon deletion without refund; any remaining credit is forfeited (section 8.5). The customer can withdraw the request until the period stated in the control panel has expired.

9.8 The right of both parties to extraordinary termination for good cause remains unaffected.

10) Blocking in the event of chargebacks, negative credit and violations

10.1 If a payment for an order is charged back via the payment service provider (chargeback) or a buyer protection case is decided in the customer's favour, the provider blocks the services ordered with this payment until the matter has been clarified.

10.2 If a top-up is charged back, the amount is deducted from the credit; the credit may become negative as a result. While the credit is negative, the customer account can only be viewed; topping up remains possible. As soon as the credit has been balanced again, the provider lifts this restriction automatically.

10.3 If there is good cause, in particular a serious or repeated violation of these GTC, the Acceptable Use Policy or applicable law, the provider may block the customer account. With the block, all of the customer's services are blocked; if the cause is not removed within 14 days, they are deleted together with all data. The provider's rights under sections 6.4, 6.5 and 7.4 remain unaffected. Section 8.5 applies to any credit remaining when an account is blocked.

11) Customer account

11.1 Natural persons, partnerships and legal persons with legal capacity can create and use a customer account without restriction.

11.2 Minor customers must provide evidence of consent from their legal guardians for the use of the provider's services. The provider may request consent in text form at any time.

11.3 For higher product prices, age verification may be required in order to comply with the German Protection of Young Persons Act.

11.4 To register, the customer provides their first and last name and a valid e-mail address, confirms it via a link sent to them and sets a password; where offered, they can also sign in via an account with a third-party provider. The customer must provide truthful details and keep them up to date. Incorrect details may lead to the account being blocked (section 10.3).

11.5 The provider attaches great importance to respectful and fair interaction. Insults or extremely unfriendly statements towards its support staff will not be tolerated. The provider strives to provide the best possible service and support, and in return expects a polite and constructive dialogue. In the event of violations, the provider reserves the right to take appropriate measures without undue delay, including terminating support services or other contractual agreements, up to and including blocking the customer account.

12) Liability

12.1 The provider is liable under all contractual, quasi-contractual and statutory claims, including claims in tort, for damages and reimbursement of expenses as follows:

12.2 The provider is liable without limitation on any legal ground

  • in the event of intent or gross negligence,
  • in the event of intentional or negligent injury to life, body or health,
  • on the basis of a guarantee, insofar as nothing to the contrary has been agreed in this respect,
  • on the basis of mandatory liability, such as under the German Product Liability Act.

12.3 If the provider negligently breaches a material contractual obligation, liability is limited to the foreseeable damage typical of the contract, unless liability is unlimited pursuant to the preceding section. Material contractual obligations are obligations which the contract imposes on the provider according to its content in order to achieve the purpose of the contract, the fulfilment of which makes the proper performance of the contract possible in the first place and on the observance of which the customer may regularly rely.

12.4 In all other respects, liability on the part of the provider is excluded.

12.5 The above liability provisions also apply with regard to the provider's liability for its vicarious agents and legal representatives.

12.6 The provider's servers are normally available around the clock, 7 days a week. No guarantee is given for uninterrupted availability; the provider is liable for data loss and interrupted data transmissions in accordance with the above provisions. Section 2.4 (data backup by the customer) remains unaffected.

13) Rendering of services

13.1 In order to ensure the functionality and stability of its infrastructure, the provider reserves the right, in the event of extraordinary utilisation of technical resources — in particular excessive or prolonged high demand on the network, the processors or the memory — to deactivate the product or even remove it entirely without prior notice in order to protect its infrastructure.

13.2 Customer support is available to customers free of charge, with certain exceptions. The provider does not offer specific administrative assistance; its customer support will, however, assist customers as best as possible within the available options. No guarantee is given for this. The provider is also entitled, by arrangement with the customer, to offer chargeable services.

13.3 Activation of the product normally takes place automatically immediately after the order. In some special cases, for example with domains, delays in provision may occur due to validation processes or third-party checks.

14) Use of the servers

14.1 The services provided by the provider must not be used to violate any applicable laws or copyrights. In addition, the provider does not tolerate the hosting (i.e. publishing, providing, storing or similar) of pornographic or sexually offensive content. Mining cryptocurrencies and comparable processes as well as penetration tests and security scans from the provider's servers are also prohibited (section 4 of the Acceptable Use Policy). The provider reserves the right to remove the service in the event of a violation of these requirements.

14.2 For technical reasons, the IP address assigned to the customer may change at any time. There is no entitlement to the assignment or reservation of specific IP addresses.

14.3 The provider reserves the right to restrict the functionality of the platform or to discontinue use of the platform entirely, insofar as this is necessary to comply with statutory requirements. It will inform customers of this in good time in advance.

14.4 Data volume. The data volume included in a service follows from the service description; for some servers it is unlimited. Once the included data volume for a month has been used up, the network speed is throttled to 1 Mbit/s until the end of the month. Where offered, the customer can add additional data volume as a one-off package; it applies only to the current calendar month, and unused volume expires at its end.

Where the data volume is stated as unlimited, there is no fixed cap and no throttling based on consumption. However, the principle of fair use applies: use must remain within what is customary for operating the applications hosted by the customer and must not impair the operation of the network or of other customers. In particular, permanent utilisation of the network connection far beyond the customary level is not covered. In the event of abuse or a considerable exceedance of this scope, the provider is entitled to throttle the network speed or to block the server; it informs the customer of this. The provider's rights under sections 6.5, 7.4 and 13.1 remain unaffected.

14.5 Windows. If the customer selects a Windows operating system, the provider activates an evaluation licence from Microsoft in the customer's name. Microsoft's licence terms, which the customer confirms when ordering, apply to its use. A licence for permanent or productive use is not part of the service unless it is expressly ordered as well.

14.6 KVM exchange. On the KVM exchange, the provider offers servers at daily prices. An offer placed in the shopping basket there remains reserved for 24 hours. The price agreed when ordering also applies to later renewals; if the customer later changes the package, the change is charged with the same percentage price advantage.

15) Domains

15.1 The provider arranges the registration of domains with the registry responsible for the respective extension. The domain is registered in the name and for the account of the customer; all rights and name rights acquired in the domain lie with the customer. The provider accepts no warranty for the availability of the desired domain or that its registration does not infringe third-party rights (e.g. name, trademark or title rights).

15.2 The provider checks the availability of a domain provisionally before the order and bindingly when the order is placed. If a domain is already registered, the customer can, where offered, transfer it to the provider at the transfer price using the auth code of the previous provider. The customer must be entitled to dispose of the domain.

15.3 The provider transmits the customer's registration or transfer request to the competent registry. The customer bears full responsibility for the lawfulness, completeness and accuracy of their request and of the owner details it contains. The provider does not normally carry out any check, not even for plausibility. The provider has no influence on the registration and is not liable for its success. The customer may only assume that the desired domain has been successfully registered once they are entered as the holder at the registry. It is the customer's responsibility to inform themselves about, and agree to, the allocation rules and terms and conditions of the registry for the respective domain.

15.4 A domain is registered for at least one year. Section 9 applies to renewal, termination and deletion; a domain that is not renewed due to insufficient credit is deleted (section 9.3).

15.5 The provider may temporarily suspend the registration and transfer of new domains. Existing domains, their renewal and their management remain unaffected.

16) Free test servers

16.1 The provider may make a free test server available to customers for 24 hours. There is no entitlement to this. Each customer account receives at most one test server per server type; to prevent abuse, the provider checks the request (in particular via the confirmation of a mobile number) and may reject it.

16.2 The test server is limited to the selected package. Package changes, additional IP addresses or backup slots, a renewal and an approval of mail sending are excluded. Otherwise, these GTC and the Acceptable Use Policy apply.

16.3 After the 24 hours have expired, the test server ends automatically without the need for termination; no costs are incurred. The server is then deleted together with all data stored on it. The provider informs the customer of this in advance.

16.4 Before expiry, the customer can take over the test server for a fee via the checkout ("Keep server"). It then continues to run with its data as a regular server; from the takeover onwards, the conditions for paid services apply.

17) 24fire+ membership

17.1 With the 24fire+ membership, the customer receives the benefits described in the control panel, such as an extended period for restoring suspended servers (section 9.3) or a higher commission in the partner programme.

17.2 24fire+ is taken out for one month or one year at the price stated when ordering and is paid for exclusively from credit. The price remains unchanged for the duration of the membership.

17.3 At the end of each term, the membership is renewed for the same term if the credit covers the price (section 9.2); otherwise it ends. The provider reminds the customer by e-mail before each renewal. The customer can terminate the membership at any time with effect from the end of the current term and withdraw the termination until then.

17.4 The provider may change or restrict the benefits of 24fire+ at any time. The scope described in the control panel at the respective time applies.

18) Donations

18.1 Customers can create their own donation pages in the control panel, which are available at spenden.24fire.de and donate.24fire.de. Via a donation page, anyone, even without a customer account, can give credit to the owner of the page (hereinafter "page owner"). The donor's contracting party for the payment is the provider; the donor receives an invoice for their payment. The amount donated is credited to the page owner's customer account as credit; section 8.5 applies accordingly.

18.2 The provider bears the fees of the payment service providers. By way of exception, a fee may be deducted from the donation amount for individual payment methods; the provider points this out separately on the donation page before the donation.

18.3 The page owner alone is responsible for the content of their donation page (such as title, description and packages); section 6.2 and the Acceptable Use Policy apply accordingly. If the page owner promises donors something in return for a package, the page owner owes it themselves; the provider is not involved in this. Customers may not use the donation page for illegal or fraudulent activities. In particular, it is prohibited to engage in deception that could create the impression that a donation or its use is officially connected with the provider.

18.4 The provider may block a donation page without stating reasons if it determines that these provisions are being violated, if illegal content is reported to it or if this is necessary to ensure proper operation. Statutory obligations to provide reasons, in particular under Art. 17 of Regulation (EU) 2022/2065 (DSA), remain unaffected.

18.5 If a donation is charged back or reversed, the provider deducts the amount credited from the page owner's credit. The credit may become negative as a result; section 10.2 applies.

19) Goods (merchandise)

19.1 Occasionally, the provider offers goods in limited quantities, such as merchandise items. These GTC apply to them with the following particularities.

19.2 Delivery is made to the delivery address provided by the customer via a shipping service provider. Delivery time, delivery area and shipping costs are stated in the respective offer. The goods remain the property of the provider until paid for in full.

19.3 The statutory rights in respect of defects apply. Section 5.4 applies to the right of withdrawal.

20) Amendment of the GTC

20.1 The provider reserves the right to amend these GTC at any time, provided the customer consents to the amendment.

20.2 The provider further reserves the right to amend these GTC even without the customer's consent,

  • insofar as it is obliged to do so due to a change in the legal situation;
  • insofar as it thereby complies with a court judgment or an official decision directed against it;
  • insofar as it introduces additional, entirely new services or service elements which require a service description in the GTC, unless the existing usage relationship is thereby changed to the customer's disadvantage;
  • where the amendment is merely advantageous for the customer; or
  • where the amendment is purely technical or procedural in nature, unless it has material effects for the customer.

20.3 The provider will inform the customer of material amendments to these GTC in good time and in an appropriate form. Material amendments are those which would significantly shift the contractual relationship to the customer's disadvantage or which would be equivalent to concluding an entirely new contract. These include, for example, provisions on the nature and scope of the service or on the contract term and termination arrangements.

20.4 The customer's right of termination remains unaffected by this.

21) Applicable law, place of jurisdiction

21.1 The law of the Federal Republic of Germany applies to all legal relationships between the parties. For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence is not withdrawn.

21.2 If the customer acts as a merchant, a legal person under public law or a special fund under public law with its registered office in the territory of the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract is the provider's place of business. If the customer has their registered office outside the territory of the Federal Republic of Germany, the provider's place of business is the exclusive place of jurisdiction for all disputes arising from this contract if the contract or claims arising from the contract can be attributed to the customer's professional or commercial activity. In the aforementioned cases, however, the provider is in any event entitled to bring proceedings before the court at the customer's registered office.

22) Severability clause

22.1 Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected thereby.

22.2 The invalid or unenforceable provision shall be replaced by a provision that comes closest to the meaning and purpose of the invalid or unenforceable provision.

22.3 The same applies in the event that these GTC contain a gap.
